In 2012, President Obama violated the constitutions when he appointed three members to the National Labor Relations Board without the approval of the senate. Recently the U.S Court of Appeals for the D.C. Circuit on Friday, January 25, ruled in a decision that would greatly limit the President’s powers in consequence to what has transpired and due to the violation of separation of power. The reasoning behind President Obama’s appointment was to create recess appointments, but the courts ruled that the president can only bypass the Senate when administration vacancies occur during a recess.
